CS 356P-5 Specified Relative Cases, Review and Adjustment

If a specified relative case meets the criteria for review and adjustment of an existing award amount, only proceed with adjustment procedures if the specified relative has been granted legal custody or guardianship of the child(ren).  Do not proceed to adjust the order if the specified relative has not been granted legal custody or guardianship.  Continue to enforce the existing order. 

 

1.                   Legal custody or guardianship granted:  If the specified relative has been granted legal custody or guardianship of the child(ren), refer to the procedures found in CS 450P General Information, Forms, Criteria, and Federal Timeframes and CS 451P Review and Adjustment of a Support Order to Include MEDICAL Support Only.  Generally, both the mother and father will need to be located and their incomes known.

 

2.                   Legal custody or guardianship NOT granted:  If a specified relative on a case in which legal custody has not been determined requests review and adjustment, inform the specified relative that CSS will not initiate any action to adjust the child support until the custody issue is resolved.  The specified relative must retain private counsel for this purpose.
